You are solely responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. 2.3. The Company shall not be liable for any loss or damage arising from your failure to comply with this Section 2.

Users shall utilize the Bot Creation Studio platform and services strictly for lawful purposes and in a manner that does not infringe upon the rights of, or restrict or inhibit the use and enjoyment of the platform by, any third party. 3.2. Prohibited activities include, but are not limited to: a. Engaging in any activity that is illegal, harmful, or fraudulent. b. Uploading, posting, or transmitting any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, or otherwise objectionable. c. Attempting to gain unauthorized access to our systems or network, or interfering with the proper functioning of the Service. d. Distributing viruses, malware, or any other malicious code. e. Engaging in spamming, phishing, or any form of unsolicited commercial communication. f. Reverse engineering, decompiling, or disassembling any aspect of the Bot Creation Studio platform. g. Creating bots or automated systems that violate any applicable laws or infringe upon the rights of others, including privacy and intellectual property rights. 3.3. The Company reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities.
4. Intellectual Property Rights 4.1. All content, features, and functionality on the botcreationstudio.com website, including but not limited to, software, design, text, graphics, logos, patents, trademarks, service marks, copyrights, and photographs, are the exclusive property of Bot Creation Studio or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 4.2. User Content: You retain all ownership rights to the content, data, and bots you create or upload to the Bot Creation Studio platform ("User Content"). By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the operation of the Service and the Company’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. 4.3. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize the Company to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all User Content to enable inclusion and use of the User Content in the manner contemplated by the Service and these Terms.
5. Disclaimer of Warranties 5.1. The Bot Creation Studio services and all content, functions, and materials made available through the Service are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 5.2. The Company does not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no warranty regarding the accuracy, completeness, or reliability of any content obtained through the Service.
6. Limitation of Liability 6.1. To the maximum extent permitted by applicable law, in no event shall Bot Creation Studio, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. 6.2. In no event shall the total aggregate liability of Bot Creation Studio for all claims arising out of or related to these Terms or your use of the Service exceed the greater of one hundred U.S. dollars ($100) or the amount you have paid to Bot Creation Studio in the twelve (12) months preceding the date of the claim.
7. Indemnification You agree to defend, indemnify, and hold harmless Bot Creation Studio, its affiliates, licensors, and service providers, and its respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
8. Termination 8.1. We may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. 8.2. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. 8.3. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Governing Law These Terms shall be governed and construed in accordance with the laws of the jurisdiction where Bot Creation Studio is incorporated, without regard to its conflict of law provisions.
10. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
